AMENDMENT OF RULES: Brill Motor Speedway reserves the right to add to, delete, supersede or modify any rules, exhibits or drawings that Brill Motor Speedway deems necessary for the betterment and/or safety of racing. The rules may be amended and subsequent publication in the rulebook. In addition, pursuant to authority conferred by the promoters, may issue amendments during the racing season in the form of serially numbered and dated technical bulleting. Participants shall be responsible for being aware of and complying with all such amendments issued in the form of technical bulletins. COMPETITOR OBLIGATION: 1. All person entering the pit area must pay a pit fee, read and sign
a form releasing the Brill Motor Speedway, LLC from any claim for personal
injury or damages, or loss of any personal equipment. All items including
tow vehicles, tools, etc. are brought into the competition area at the
owner’s own risk, and are not covered by any insurance policies. TOP TEN QUALIFIERS: All participants must attend 65% of races to be eligible for top ten jackets and trophies. FINALITY OF DECISIONS AND INTERPRETATIONS AND CONVENT NOT TO SUE: 1. The decisions of Brill Motor Speedway, track officials, at the sanctioned racing event, including the interpretations and application of rules and the scoring of positions, shall be final binding and not apealable. 2. All participants, as a condition of participating in a racing event, agree that all decision of track officials, regarding the interpretation and application of the rules, and the scoring of positions, shall be non-litigable. All participants further covenant and agree that they will not initiate any type of legal action against Brill Motor Speedway promoters, to challenge such decisions, to seek monetary damages, to seek injunctive relief, or to seek any other kind of legal remedy. If a participant pursues any such legal action which violates this provision, then the participant expressly agrees to reimburse Brill Motor Speedway for all of its attorneys fees and costs in defending against such legal action., VIOLATION OF SPIRIT OR INTENT OF RULES: UN-SPORTSMAN LIKE CONDUCT: Any participant who defies or violates the spirit or intent of the Brill Motor Speedway rules shall be considered to have engaged in un-sportsman like conduct and shall be dealt with by promoter or track official depending upon the nature of the infraction. Un-sportsman like conduct will result in a fine of up to $1,000.00 and/or a suspension of up to one year, or more, and/or probation for up to one year or more from the date of infraction. RESERVED PARTICIPATION RIGHT: The track promoter reserves the right to refuse to accept the entry of any car or participant at anytime. Furthermore, Brill Motor Speedway reserves the right to revoke or cancel any entry, or any participants claimed right to be on the track premises. If it is felt or determined that a participants presence or conduct is not in the best interest of the sport of auto racing, the other competitors, the spectators, track management and/or employees of Brill Motor Speedway. CONDUCT: 1. Fighting: Any participant directly involved with any fighting or misconduct at any Brill Motor Speedway event, on the racetrack, in the pits, or on the track premises, at any time will be fined up to $500.00. And/or may be suspended from all events for two weeks from the date of infraction. May forfeit all points to the date of the infraction and all prize money earned for the event as deemed necessary by the promoter. Any driver or pit crew going to another drivers pit area for confrontation will be escorted out of the pit area and subject to a two weeks suspension and/or fine. 1st offense – Driver will loose all points accumulated for the
year and will be suspended for 2 weeks. 2. Assault/Abuse of Official: No participant shall subject any track official, track employee or sponsor to any abusive or improper language at any time. Any driver who gets out of his/her race car, or any participant, who assaults or threatens any track official, track employee or sponsor, may be suspended for up to two weeks from the date of infraction. And may be fined up to $500.00 and shall forfeit all Brill Motor Speedway points. 3. Alcoholic Beverages: Consumption of beer or alcoholic beverages in the pit area, or being under the influence of beer or alcoholic beverages in the pit area, is prohibited until the entire program for all divisions is completed. If a participant, or pit man is caught consuming alcoholic beverages in the pit area, or is deemed to be under the influence of alcoholic beverages before the entire program for all divisions is completed, he/she shall be immediately ejected from the race track premises. And shall be subject to a mandatory 90 days suspension. This will be watched very closely!! BRILL MOTOR SPEEDWAY DRUG POLICY: Illegal Drugs, Definition: Illegal drugs are those substances or drug substances defined and prohibited by state and or federal laws. General Prohibition: Possession or use of illegal drugs or drug substances, as defined above, is prohibited in any form, by any participant at Brill Motor Speedway, either on the speedway grounds or in any area considered to be used in the operation of the speedway, such as parking lots or leased properties. Specific Prohibition, Violations and Penalties: Any person who is found to be in possession of, or under the influence of any illegal drug or drug substance on the speedway property; or arrested by duty constituted authorities and charged with possession and/or use of illegal drugs or drub substances, regardless of whether the offence occurred on or off the speedway property, or formally charged by a court of law with any illegal drug violation, regardless of whether the offence occurred on or off the speedway property. Shall be Subject to the Following Penalties: 1. Suspension from competition and eviction from all Brill Motor Speedway
events, and denial of further entry to events for a period to be determined
by the promoter. APPEAR AND HEARING: Any participant suspended for violation of these drug policy rules will be granted a formal appeal hearing by a panel designated by Brill Motor Speedway, provided the suspended participant requests such a hearing, to the board in writing, within 14 calendar days of the date of suspension. It is the responsibility of the suspended participant to make such a request for a hearing. REINSTATEMENTS: 1. A participant suspended for violation of these drug policy rules,
EXCEPT IN THE CASE OF PERSONS CHARGED WITH SELLING DRUGS, may as the
result of a decision reached through the appeal and hearing process
to reinstated if: In the case of drug use it is mutually agreed that
the participant, at his or her own expense, will produce documentation
from a physician licensed within the state, certifying that he or she
is drug independent, as a result of random and periodic examinations
and urinalysis testing, made at the request of Brill Motor Speedway. PRESCRIBED DRUGS: If a participant is using prescription drugs on the advice of a physician, such use must be reported to the chief pit steward or racing director prior to the participant’s entry into any speedway activities. Failure to notify will subject the participant to penalties as prescribed above. ILLEGAL PARTS: 1. Illegal parts shall be any parts or components of an race car which
violates or results in an violation, of any rules or specifications. PROTEST: All non-official protests must be submitted in writing to a track official
within 15 minutes after completion of the race protested. All protest
fees must be in cash and must accompany written protest from driver
or owner of a car that participated in the same race with the car protested.
Receipts will be issued to the protestor by track personal. Laboratory
fees, or any off track charges will be deducted from the protest fee.
RESERVED TEAR DOWN RIGHT: 1. Tear down: INDEPENDENT CONTRACTORS: All participants are independent contractors and are not the agents or employees of the speedway. Brill Motor Speedway participants as independent contractors, are solely responsible for preparing their race cars, to perform in racing events, in accordance with the speedway rules and procedure. As independent contractors, participants are solely responsible for compensating their employees, agents or pit crews. Participants, as independent contractors, also assume full responsibility for reporting or filing any reports or tax returns with the appropriate authorities on any and all earnings. Funds received as a result of the participation in racing events, including but not limited to, federal social security taxes, federal income taxes, state income taxes, federal and state withholding taxes, unemployment taxes and workers compensation insurance. COMPETITOR AGREEMENT REGARDING RULES: A participant by competing in a Brill Motor Speedway racing event, specifically agrees and acknowledges the following: 1. That by participating in a racing event, he or she specifically
agrees to abide by all of the speedway rules and procedures. RACE CANCELLATIONS: If a race is cancelled for any reason prior to completion of the heat races, all admission fees will be refunded. No purse will be paid. If the races are cancelled during or after the heat races, all money will be paid for the events completed. The balance of the purse and events will be added to a later program as time permits, as decided by the track promoter. Brill Motor Speedway recommends that each pit have a working fire extinguisher accessible to pit crew at all times. Any point not covered here will be decided on by the track promoter
and his decision will be final. |
